ALI-ELI Principles for a Data Economy presented at international conference on Industrial Data Sharing in Geneva

On 7 June 2022, Project Co-Reporter Christiane Wendehorst presented the ALI-ELI Principles for a Data Economy at a conference organised by the University of Geneva and the Swiss Digital Law Center.

The public and academic discourse regarding data sharing agreements currently is in full swing. On the occasion of the Intellectual Property Day on 7 June 2022, the team of the Digital Law Center and its Director Professor Jaques de Werra brought together a number of renowned experts in the field of the data economy for a morning workshop, followed by a public conference in the afternoon. The event brought together representatives from the public sector, practitioners as well as legal scholars to discuss some of the unresolved issues around data sharing agreements.

Professor Christiane Wendehorst (Project Reporter, ELI) presented the ALI-ELI Principles for a Data Economy and how the proposed default terms for different data sharing agreements (e.g. contracts for the transfer of data, contracts for simple access to data) can be used by contractual parties, as well as how the Principles’ concept of data rights and of third-party protection in the context of data sharing may inform global legal thinking. The solutions proposed by the ALI-ELI Principles can also be used by courts or arbitral tribunals worldwide and are also intended to serve as a source of inspiration for the creation of new legislation in this field.
