The Digital Services Act Package – Revolution or More of the Same?

The Digital Services Act legislative package aims to create a safer digital space where the fundamental rights of online users are protected, and to create a level playing field to foster innovation, growth and competitiveness. At ID Law 2021, we took a closer look at the European Commission's proposals presented in December 2021. A video of all the sessions is now available.

In early March, the 2nd annual Innovation and Digitalization in Law 2021 conference took place online. Experts from different areas of law gathered to review the proposals for a Digital Services Act (DSA) as well as the Digital Markets Act (DMA), compare the legislative initiatives with the status quo, and discuss the future of digital services in the EU. The organizing team was honored to welcome Karoline Edtstadler, Austrian Federal Minister for the EU and Constitution, and Brigitta Zöchling-Jud, Dean of the Faculty of Law at the University of Vienna, to open the conference. The program included a series of sessions that took a closer look at specific aspects of the DMA (e.g., duties, enforcement) and the DSA (exemption from liability for intermediary service providers, due diligence, enforcement). Each session included one to two presentations on specific aspects of the proposals, as well as commentary on the presentations and discussions with the conferees. The conference concluded with a panel discussion titled "The DSA and the DMA - Changing Everything to Change Nothing?" in which panelists represented various stakeholders involved in the platform economy.
