Regulating AI – The Perspective of the German Data Ethics Commission

On Thursday the 8th of July 2021, Christiane Wendehorst contributed to the Online-Conference of the Institute for Digital Law Trier “Regulating AI. The Commission’s proposal for an Artificial Intelligence Act: Legal Assessments” with her presentation “The perspective of the German Data Ethics Commission”.

On 21 April 2021, the EU Commission presented a proposal for an Artificial Intelligence Act (AIA), which introduces a risk-based approach to regulating artificial intelligence (AI) in Europe. Among the sources the EU Commission relied on in drafting this legislation was the 2019 opinion of the Data Ethics Commission, an expert body that advised the German government on ethical guidelines and a legal framework for data, artificial intelligence and algorithmic decision-meking. As co-chair of the Data Ethics Commission, Wendehorst gave the audience first-hand impressions of how the Data Ethics Commission would have accesses the AIA, compared the proposal of 21 Spril 2021 with the 2019 opinion and pointed out some areas for improvement in the proposal.
